Warranty Information

Limited Warranty - Limitation of Liability

Kerr represents and warrants that Kerr's Jewelry & Specialty Products shall be free from defects in material and workmanship for a period specified on each product from the date of shipment to Purchaser. Purchaser must return the warranty registration card, which accompanies the Product, within 15 days of purchase to validate this warranty.

In the event of a defect in material or workmanship covered by the above Warranty, Kerr's sole responsibility shall be, at its option, to replace or reimburse the actual cost of the defective Product. EXCEPT AS EXPRESSLY PROVIDED ABOVE, THERE ARE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES WITH RESPECT TO DESCRIPTION, QUALITY, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

In no event shall Kerr be liable to Purchaser for any direct, indirect, special, incidental or consequential damages, or for any damages resulting form loss of use or profits, anticipated or otherwise, arising out of, related to or in connection with this Agreement, whether such claim is based on contract, tort (including negligence), or theory of strict liability. In no event shall Seller's total liability for any damages arising out of, relating to or in connection with this Agreement exceed the purchase price of the Products which are the basis of such claim. Any cause of action against Kerr must be brought within one year after the cause of action becomes known.

This Warranty does not apply to any Product that has been subject to misuse, abuse, accident, disaster, or which has been operated contrary to current instructions relating to installation, maintenance or operation, or contrary to industry standards applicable to the Products.

In the event that of a defect covered by the above Warranty, Purchaser must return the Product to the Dealer from whom the Product was purchased. If unable to return it to the Dealer, Purchaser should contact Kerr for instructions:

Merchandise will not be accepted without prior authorization.

Technical advice from Kerr, whether verbal or in writing, is designed to assist customers in using Kerr products. Such advice does not alter, amend, modify or expand Kerr's Limited Warranty set forth above. The Purchaser is responsible for testing Kerr products to determine their suitability for the intended uses and assumes all risk and liability for damages arising out of improper use of Kerr products.

Returns & Repairs

Returned Merchandise

Merchandise will not be accepted without a return authorization number. After receipt and inspection, merchandise will be accepted for exchange or credit under the following conditions.

  1. Merchandise received in saleable condition will be subject to a Handling Charge of 10%.
  2. Merchandise requiring repackaging or special handling to make saleable will be subject to Returned Goods Charge of not less than 15%.
  3. Merchandise that has been out of our factory for 30 days will not be accepted for exchange or credit.
  4. Used, obsolete or discontinued merchandise or equipment will not be accepted for exchange or credit.
  5. Any goods being returned to our factory must be shipped prepaid.

Claims

Prices are "ex works" factory, Romulus (Detroit), Michigan, unless otherwise specified. Acceptance by the transportation companies, railway, truck, or express, terminates our responsibility after merchandise is delivered in good order to them and receipted for by them.

Claims or mistakes, shortages, etc. must be made within 5 days after receipt of goods. Direct customers of Kerr are responsible for "Checking and Inspection" of shipments received from Kerr to make claim against errors and mistakes. Products forwarded from a Dealer to your customers without inspection is done so at the "Dealer's Risk".
